THE LAW: 

Section 99 of the Crimes Act 1900 (NSW) constitutes it a criminal offence to, with menace, or by force, demand any property from any person, with intent to steal the same. Section 4 of the Crimes Act 1900 (NSW) defines property as including every description of real and personal property.

 

WHAT IS THE PENALTY FOR THE OFFENCE OF DEMANDING PROPERTY WITH INTENT TO STEAL?

Section 99 of the Crimes Act 1900 (NSW) provides for a maximum penalty of 10 years imprisonment for anyone convicted of the criminal offence of demanding property with intent to steal. If the offence is committed in the company of another person or persons, the maximum penalty is 14 years imprisonment.

This section of the legislation also states that it is immaterial if the menace of violence or injury is by the offender or by any other person.

 

ST CLAIR TEENAGER CHARGED WITH DEMANDING PROPERTY WITH INTENT TO STEAL

A 12-year-old boy was arrested and charged for the alleged armed robbery of a tobacconist in St Clair and a subsequent attempt to rob a service station in St Clair.

In the first incident, the boy is alleged to have demanded money and vapes prior to threatening the tobacconist attendant with a knife. The boy failed to obtain money although did obtain vapes and an energy drink. The tobacconist employee was not physically injured in the ordeal.

Later that evening, the boy is alleged to have entered a service station and threatened the service station attendant with a knife while demanding cash and cigarettes. The boy left the store empty handed and the service station attendant was not physically injured in the ordeal.

The boy was subsequently arrested by officers from the Nepean Police Area Command and charged with robbery armed with offensive weapon and demand property with menaces with intent to steal.

He was refused bail.

 

MAN CHARGED AFTER THREATENING ELDERLY WOMAN

A 19-year-old man was arrested and charged with the criminal offence of demand property with menaces with intent to steal after allegedly breaking into a 91-year-old woman’s home and threatening her and stealing her car on 20 February 2025.

Police were called and not long after they located the vehicle that the man was alleged to have stolen, abandoned and damaged near the alleged victim’s house. Later that day, the alleged offender was arrested and charged.

In addition to the criminal offence of demand property with menaces with intent to steal, the man was also charged with take and drive conveyance without consent of owner, stalk/intimidate intend fear physical harm, and aggravated enter dwelling with intent knowing people there.

The man was refused bail.

 

LOCALS FED UP WITH CRIME SPREE

Reports continue to emerge of locals across different towns in NSW being fed up with crime sprees, including the committing of the offence of demanding property with intent to steal. Residents in the NSW coastal community of South West Rocks claim to be living in fear after suffering home invasions, car thefts and vandalism. One store owner described the situation as “nuts” and “out of control”, stating that it was well known who the offenders are.
