WHO SUSPENDS A NSW P-PLATE DRIVER LICENCE?

Transport for NSW are the driver licensing authority in NSW and they have the authority to suspend a NSW Driver Licence for the loss of a P-Plate driver’s demerit points.

HOW CAN I APPEAL A SUSPENDED NSW DRIVER LICENCE?

P-Plate Driver Licence holders who have lost their demerit points and received a Notice of Suspension letter from Transport for NSW can apply online through the link enclosed on the letter for the matter to be heard and dealt with in the Local Court.

The application can also be made at the Local Court.

HOW LONG DO I HAVE TO APPEAL A SUSPENDED DRIVER LICENCE?

If you are a P-Plater and you have received a Notice of Suspension from Transport for NSW, you have 28 days to lodge an appeal. Notices are considered by law to be received within four working days after they are posted.

The court may not hear the matter if the deadline is missed, so be sure to contact us immediately.

CAN I KEEP DRIVING WHILE MY DRIVER LICENCE SUSPENSION APPEAL IS BEING HEARD?

If you appeal a Transport for NSW issued Driver Licence suspension, the suspension will be paused and you can continue driving until your appeal is heard by the Local Court, provided your appeal is filed at least one day before your suspension is due to begin.

WHAT HAPPENS AFTER THE APPEAL IS FILED?

After the Appeal is filed, a Court date will be set for your Appeal to be heard in the Local Court. You will receive correspondence advising you of the date, time and location of the Appeal. You will be expected to attend the Driver Licence Appeal in person.

WHAT WILL THE COURT CONSIDER IN MY APPEAL OF SUSPENDED DRIVER LICENCE?

The Court will consider objective and subjective factors of your offending, including:

Your level of remorse

Evidence in support of your remorse may include a written apology letter and character references attesting to your remorse.

Requirement of your licence for employment, educational or family reasons

Evidence in support of the proposition that you require your licence for work, study or family reasons can include an employer letter, financial records, proof of university enrolment and medical or carer documents.

Circumstances of your driving and offending

Evidence in support of the circumstances may include environmental and situational context.

There is some other good reason that the Court should overturn the suspension.

WHAT ORDERS CAN THE COURT MAKE?

The Court may decide to:

Uphold your appeal and allow you to keep driving.
Dismiss the appeal but vary your suspension.
Dismiss your appeal completely and require you to serve the full suspended time.
