WHAT IS THE OFFENCE OF ASSAULT WITH INTENT TO COMMIT A SERIOUS INDICTABLE OFFENCE?

Section 58 of the Crimes Act 1900 (NSW) constitutes the criminal offence of assault with intent to commit a serious indictable offence as occurring when a person assaults any person with intent to commit a serious indictable offence or assaults any person, with intent to resist or prevent the lawful apprehension or detainer of any person for any offence.

 

WHAT IS A SERIOUS INDICTABLE OFFENCE?

The criminal offence of assault with intent to commit a serious indictable offence is better understood with the knowledge of what an actual serious indictable offence is. A serious indictable offence is any offence that is punishable by imprisonment for life or for a term of 5 years or more.

 

WHAT IS THE PENALTY FOR ASSAULT WITH INTENT TO COMMIT A SERIOUS INDICTABLE OFFENCE?

Section 58 of the Crimes Act 1900 (NSW) provides for a maximum penalty of 5 years imprisonment for anyone convicted of the offence of assault with intent to commit a serious indictable offence.

 

NSW GOVERNMENT TRIAL TO REDUCE ASSAULTS IN HOSPITALS

The NSW Government has commenced a 12-month trial involving hospital security staff wearing body cameras, intended to reduce the number of assaults on nurses, patients and other staff, including the offence of assault with intent to commit a serious indictable offence. The Royal North Shore Hospital was the first to start the trial, before the inclusion of a further 14 city and regional hospitals across NSW.

During the trial, each security guard at the respective participating hospitals is to wear a body camera, with the camera to be turned on during incidents that involve aggression and violence, or where there is risk of harm to staff, patients or others.

The trial is in response to a review of hospital security which reported a disturbing increase in aggressive and violent behaviour.

The trial is one of numerous measures that have been introduced, including workplaces designed to enhance line of sight for staff, Code Black duress response teams, personal mobile and fixed duress alarms for staff to ensure they can summon assistance when necessary, lighting to ensure visibility and CCTV.

The impact of the trial on the offence of assault with intent to commit a serious indictable offence will be determined.

 

MAN CHARGED AFTER ALLEGEDLY ASSAULTING FOUR PEOPLE

A man has been charged with assault with intent to take/drive motor vehicle among numerous other criminal offences after having allegedly assaulted four people in Sydney’s Inner West.

It is alleged that the man approached a 49-year-old woman in the carpark of a store in Rozelle and demanded her car keys, before assaulting her. A good Samaritan assisted the woman before following the man and allegedly being assaulted by him.

A short time later, emergency services were called to a unit in Rozelle, following reports of an assault. Police allege that the man had assaulted a man and woman in the unit, prior to assaulting the woman again outside after she had fled the unit.

The alleged offender was taken to hospital under police guard and was refused bail.
