WHAT IS A LICENCE APPEAL?
Licence Appeals are appeals heard before a Magistrate in the Local Court for a driving suspension to be waived or reduced. The appeals can be made in situations whereby your NSW Driver Licence is to be suspended for exceeding the speed limit by more than 30km/h or more than 45km/h or you are a P-Plater and your NSW Driver Licence is to be suspended due to an accumulation of demerit points.
If you have an unrestricted NSW Driver Licence and you’ve received a notice of suspension due to excessive demerit points, you cannot appeal a suspension of your NSW Driver Licence. However, you may be eligible to elect a 12-month good behaviour period or seek to have a charge dismissed pursuant to section 10, resulting in no suspension or disqualification. NSW P-PLATER FACES DRIVING SUSPENSION FOR SPEEDING 60KM/H OVER LIMIT
A P-Plate driver had his licence suspended on the spot for 6 months, having been caught by Police driving 130km/h in a 70km/h zone in Sydney’s south. He was also hit with a $2,794 fine.
Police have the authority in NSW to issue a licence suspension at the roadside if a driver is caught speeding by more than 45km/h over the speed limit.
Meanwhile, a man in NSW had his NSW Driver Licence suspended and was issued $7000 in fines arising from his claims that he was fraudulently nominated for 14 driving offences through vehicles registered to two companies in Victoria. In a photo of one of the alleged offences published by 9News, it appears clear that it is in fact a woman driving the vehicle.
The man stated that he had contacted numerous government agencies and had signed a statutory declaration and police report to no avail, describing the process to clear his name as ‘very convoluted’.
