No Conviction for Driving While Suspended at Liverpool Local Court

Criminal Lawyers Group recently appeared at Liverpool Local Court representing a client charged with Driving While Suspended.

Our client was a young professional working full-time while also completing further tertiary studies to advance his career. He relied heavily on his ability to maintain employment and continue building his professional future.

On the day of the offence, our client made a poor decision to drive despite knowing his licence was suspended. He was stopped by police for a random check, at which point his suspension was detected.

Naturally, our client was extremely concerned about the consequences. A criminal conviction would have significantly impacted his career prospects, particularly given his aspirations for advancement in a competitive professional field.

We immediately took proactive steps to prepare his matter in the strongest possible way.

We obtained a number of compelling character references from colleagues, friends, and family, all of which spoke to his otherwise excellent character, strong work ethic, and low likelihood of reoffending.

Our team also guided the client in preparing a detailed and sincere letter of apology. In this letter, he expressed genuine remorse, insight into his offending, and an understanding of the seriousness of driving while suspended.

To further demonstrate his commitment to rehabilitation, our client enrolled in and completed a Traffic Offender Program, equipping him with greater awareness and safer driving practices.

At court, we made comprehensive submissions to the Magistrate, emphasising:

  • His lack of any prior criminal history
  • His genuine remorse and insight
  • His strong employment record and future career ambitions
  • The steps he had taken toward rehabilitation

We submitted that this was an isolated lapse in judgment and that a conviction would be disproportionate to the circumstances.

Following our submissions, we successfully persuaded the Court to deal with the matter by way of a Conditional Release Order without conviction for a period of 2 years.

This result ensured that our client avoided a criminal record, allowing him to continue pursuing his career and educational goals without the burden of a conviction.
