WHAT IS A CLERK OR SERVANT?

Section 157 of the Crimes Act 1900 (NSW) defines a clerk or servant as:
Every person employed for any purpose, as, or in the capacity of, a clerk, or servant, or as a collector of moneys, although temporarily only, or employed also by other persons, or employed to pay as well as receive moneys, or although the person had no authority from his or her employer to receive money, or other property, on his or her account, shall be deemed a clerk, or servant.
WHAT IS THE PENALTY FOR THE CRIMINAL OFFENCE OF LARCENY BY CLERKS OR SERVANTS?
Section 156 of the Crimes Act 1900 (NSW) prescribes a maximum penalty of 10 years imprisonment for anyone convicted of the criminal offence of Larceny by clerks or servants. If the matter is finalised in the Local Court, the maximum penalty available is 2 years imprisonment.
Other penalties available for a conviction of the criminal offence of Larceny by clerks or servants include a Suspended Sentence, Intensive Corrections Order (ICO), Community Corrections Order (CCO) and a Good Behaviour Bond.

MAN CHARGED WITH THREE COUNTS OF STEAL PROPERTY AS CLERK/SERVANT
A 44-year-old man has been charged with three counts of Steal property as clerk/servant, after being arrested in Maddens Plains near Bulli Pass, on 2 June 2025.
The arrest and charges follow a report that was made in 2023 alleging fraudulent transactions being made by an employee of a business in Wollongong. Police allege that 82 fraudulent transactions were made, totalling more than $395,500.
The man was also charged with dishonestly obtain financial advantage etc by deception and knowingly deal with proceeds of crime.
He was refused bail.
