Our client, a 38-year-old male, was charged with charged with the possession of multiple firearms including a Glock pistol and rifles. Initially, our client was being represented by another law firm. THE PLAN OF ATTACK:
Steven swiftly drafted representations to police to roll up the charges into a single offence. These representations were successful. It was an appropriate case to put forward an argument that the client should be release on a community based good behaviour bond. Steven was able to demonstrate that the firearms were located within a box in a storage unit and had not been accessed by anyone and were not in working order in the way they were found. He argued that there was no link to organised crime and that any suggestion by police of an association with criminal groups could not be proven beyond a reasonable doubt on the evidence that was presented at court. Further, he cross-examined a key informant witness who reluctantly accepted under vigorous questioning that there were no witnesses that were willing to come forward and provide evidence to establish our clients link to organised crime. Further, there was no police surveillance to establish his connection to organised crime.
RESULT:
Steven argued for our client to be released on a community-based order, which the Magistrate ultimately agreed to, and he was released immediately on an 18-month good behavior bond.
