DRUG TRAFFICKING OFFENCES IN NSW

THREE MEN CHARGED WITH DRUG TRAFFICKING OFFENCES

Two Chinese nationals and a Sydney man have been charged by the AFP with drug trafficking offences over a failed plot to import over half a tonne of illegal drugs into Australia in 2024. The investigation into the plot also identified two further individuals, both Chinese nationals from Auburn, who were charged with the alleged possession of precursor chemicals.

The arrests and charges were the result of a joint investigation by the AFP and Australian Border Force (ABF) which commenced in July last year. The investigation was triggered by the finding of the MDMA and methamphetamine that are the subject of the charges in a consignment of galvanized hooks, which arrived at the Port of Melbourne having been sent from Italy. The AFP substituted the illegal drugs with an inert substance, delivered it to an address in Victoria, before tracking its transportation to a storage facility in Auburn, NSW.

The drugs are alleged to have included 421kg of MDMA pills with an estimated street value of approximately $26 million, 120kg blocks of an illicit substance suspected to be ‘pink cocaine’ with a potential street value of up to $16.8 million and 80kg of methamphetamine with an estimated street value of almost $74 million.

THREE ACCUSED OF DRUG TRAFFICKING OFFENCES FACING LIFE IMPRISONMENT

The initial two Chinese nationals and the Sydney man were charged with two counts of import a commercial quantity of a border controlled drug, namely MDMA and methamphetamine, contrary to section 307.1(1) of the Criminal Code (Cth); and two counts of attempt to possess a commercial quantity of a border controlled drug, namely MDMA and methamphetamine, contrary to section 307.5(1) by virtue of subsection 11.1 of the Criminal Code (Cth).

Each of these offences carry a maximum penalty of life imprisonment.

FURTHER TWO ACCUSED ALSO FACING SERIOUS PENALTIES

The two Chinese nationals from Auburn were each charged with one count of possessing a precursor intended for use in the manufacture or production of a prohibited drug, contrary to section 24A of the Drug Misuse and Trafficking Act 1985 (NSW).

This offence carries a maximum penalty of 10 years imprisonment.

One of the two Auburn men was also charged with one count of contravening requirements in a section 3LA order when the warrant relates to a serious offence, contrary to section 3LA(6) of the Crimes Act 1914 (Cth). This offence also carries a maximum penalty of 10 years imprisonment.
