- Use coercion, threat or deception; and
- That use of coercion, threat or deception results in the person obtaining the other person’s compliance in respect of that exit or proposed exit.
WHAT IS THE PENALTY FOR THE CRIMINAL OFFENCE OF TRAFFICKING IN PERSONS?
Section 271.2 of the Criminal Code Act 1995 (Cth) prescribes a maximum penalty of 12 years imprisonment for a person convicted of the criminal offence of Trafficking in Persons.
If a person commits an aggravated offence of Trafficking in Persons, the maximum penalty pursuant to Section 271.3 of the Criminal Code Act 1995 (Cth) is a term of imprisonment of 20 years.
WHAT CONSTITUTES AN AGGRAVATAED OFFENCE OF TRAFFICKING IN PERSONS?
Section 271.3 of the Criminal Code Act 1995 (Cth) constitutes an aggravated offence of Trafficking in Persons as having been committed if the person commits the offence of trafficking in persons in relation to another person and any of the following applies:
- The person commits the offence intending that the victim will be exploited, either by the person or another:
- The offence of trafficking in persons is an offence against subsection 271.2(1), (1B), (2) or (2B)–after entry into Australia; or
- If the offence of trafficking in persons is an offence against subsection 271.2(1A), (1C), (2A) or (2C)–after exit from Australia;
- The person, in committing the offence, subjects the victim to cruel, inhuman or degrading treatment;
- The first person, in committing the offence engages in conduct that gives rise to a danger of death or serious harm to the victim or another person and is reckless as to that danger.

SYDNEY MAN CHARGED WITH CRIMINAL OFFENCE OF TRAFFICKING IN PERSONS
A Sydney man has been charged with the criminal offence of Trafficking in Persons, arising from allegations that he deceptively convinced his wife and child to travel to Pakistan with him, before taking the child’s passport on arrival in Pakistan and abandoning his wife and child at the airport.
The man is alleged to have returned to Australia later that same month and is alleged to have subsequently fraudulently cancelled his wife’s Australian visa and retained possession of the child’s passport.
AFP Detective Acting Superintendent Luke Needham stated that “Carrying out actions to force or encourage someone to travel overseas and then impede their ability to return to Australia can be a serious criminal offence, and the AFP will not hesitate to act when we have evidence of criminal actions.”
