WHAT IS THE CRIMINAL OFFENCE OF KIDNAPPING?
The criminal offence of kidnapping is enshrined in Section 86 of the Crimes Act 1900 (NSW), which constitutes it a criminal offence to take or detain a person, without the person’s consent:
- with the intention of holding the person to ransom, or
- with the intention of committing a serious indictable offence, or
- with the intention of obtaining any other advantage
WHAT IS THE PENALTY FOR THE CRIMINAL OFFENCE OF KIDNAPPING?
A person convicted of the basic criminal offence of kidnapping under Section 86(1) of the Crimes Act 1900 (NSW) is liable for a maximum term of imprisonment of 14 years. A conviction of the criminal offence of kidnapping may also have serious repercussions on your professional career and personal life.

THE AGGRAVATED OFFENCE OF KIDNAPPING
Section 86(2) of the Crimes Act 1900 (NSW) prescribes an aggravated offence of kidnapping with a greater term of maximum imprisonment than the basic offence of kidnapping. A person is convicted of the aggravated offence of kidnapping if:
- The person commits a basic offence of kidnapping in the company of another person or persons, or
- The person commits a basic offence of kidnapping and at the time of, or immediately before or after, the commission of the offence, actual bodily harm is occasioned to the alleged victim.

WHAT IS THE PENALTY FOR THE AGGRAVATED OFFENCE OF KIDNAPPING?
Section 86(2) of the Crimes Act 1900 (NSW) prescribes a maximum penalty of 20 years imprisonment for a person convicted of the aggravated offence of kidnapping.

SPECIALLY AGGRAVATED OFFENCE OF KIDNAPPING
Section 86(3) of the Crimes Act 1900 (NSW) prescribes a specially aggravated offence of kidnapping with a greater term of maximum imprisonment than the basic offence of kidnapping and aggravated offence of kidnapping. A person is convicted of the specially aggravated offence of kidnapping if the person commits a basic offence of kidnapping:
- In the company of another person or persons, and
- At the time of, or immediately before or after, the commission of the offence, actual bodily harm is occasioned to the alleged victim.

WHAT IS THE PENALTY FOR THE SPECIALLY AGGRAVATED CRIMINAL OFFENCE OF KIDNAPPING?
Section 86(3) of the Crimes Act 1900 (NSW) prescribes a maximum penalty of 25 years imprisonment for a person convicted of the specially aggravated offence of kidnapping.
BEVERLY HILLS WOMAN FOUND DEAD AFTER SUSPECTED KIDNAPPING AND MURDER
A body believed to be a woman kidnapped from a house in Beverly Hills has been found in a burnt out car.
Police are searching for 5 men they believe are responsible for kidnapping the woman, an incident which included the assault of an 8 year old boy who was also at the house and who witnessed the suspected kidnapping alongside a 15 year old boy.
The 15 year old boy told Police that 5 masked men, some of whom were armed, had forced their way into the house, before forcing the woman into a vehicle.
Superintendent Rodney Hart labelled the suspected crime horrendous and stated that it displayed an unheard of level of violence. Police believe the suspected crime was targeted and Superintendent Hart has advised the community that there was no further danger to the community.
