WHAT IS THE CRIMINAL OFFENCE OF FIRING AT DWELLING-HOUSES OR BUILDINGS?

Commonly referred to as drive-by shootings, the criminal offence of firing at dwelling-houses or buildings is constituted as a criminal offence pursuant to Section 93GA of the Crimes Act 1900 (NSW), which defines the criminal offence of firing at dwelling-houses or buildings as the firing by a person of a firearm at a dwelling-house or other building with reckless disregard for the safety of any person.

 

WHAT IS THE PENALTY FOR THE CRIMINAL OFFENCE OF FIRING AT DWELLING-HOUSES OR BUILDINGS?

Section 93GA of the Crimes Act 1900 (NSW) prescribes a maximum penalty of 14 years imprisonment for a person convicted of the criminal offence of firing at dwelling-houses or buildings.

If the criminal offence of firing at dwelling-houses or buildings was committed during a public disorder or in the course of an organised criminal activity, the maximum penalty is 16 years imprisonment.

 

WHAT IF NO-ONE WAS IN DANGER DURING THE CRIMINAL OFFENCE OF FIRING AT DWELLING-HOUSES OR BUILDINGS?

Section 93GA of the Crimes Act 1900 (NSW) deems it not necessary for the prosecution to prove that a person was actually placed in danger by the firing of the firearm, in order for a conviction of the criminal offence of firing at dwelling-houses or buildings.

 

SYDNEY GRANDMOTHER KILLED IN DRIVE-BY SHOOTING

A 65-year-old woman has been killed in a drive-by shooting in the South-Western Sydney suburb of Ambarvale.

Police state that they believe up to three people got out of a dark vehicle and fired at the dwelling-house with multiple gunshots, one of which was believed to have struck the victim in the leg and ultimately killed her.

The victim was inside a front lounge room of the house at the time of the attack and could not be saved by police and paramedics who had treated her. A 34-year-old man and a 21-year-old woman were also at the property at the time of the shooting, although were not injured in the attack.

 

Superintendent Healey described the offence, stating “It’s abhorrent, somebody coming up to a house and putting shots off is totally reckless and the consequences are catastrophic.”

Police believe the attack was targeted and are continuing investigations, although police don’t know if the grandmother herself was specifically targeted. They have established Strike Force Apslawn, with the assistance of the State Crime Command’s Homicide Squad.

GUILDFORD WEST DWELLING-HOUSE FIRED AT WITH FIREARM

A Guildford West dwelling-house has been fired at with a firearm while a 26-year-old woman referred to as having been “completely traumatised” from the attack was inside the dwelling. There were no reported injuries from what appeared to be the commission of the criminal offence of firing at dwelling-houses or buildings.

Superintendent Watt stated that a man was spotted running from the scene with his face covered and dressed in dark clothing and the Superintendent told reporters that the man was seen leaving in a grey SUV.

A torched car was later found in Villawood.

Police stated that it’s too early to determine whether the firing at the dwelling-house or building in Ambervale and the firing at the dwelling-house or building in Guildford West were linked.
