- a prohibited drug or prohibited plant, or
- a drug supply process, or
- any equipment capable of being used to administer a prohibited drug.
WHAT IS THE PENALTY FOR THE CRIMINAL OFFENCE OF ALLOWING USE OF PREMISES AS DRUG PREMISES – EXPOSE CHILD TO DRUGS?
Section 36Y (2) of the Drug Misuse and Trafficking Act 1985 (NSW) prescribes a maximum penalty of a $6,600 fine and/or 14 months imprisonment for a person convicted of the criminal offence of Allowing use of premises as drug premises – Expose child to drugs for the first offence.
Other penalties available for a conviction of the criminal offence of Allowing use of premises as drug premises – Expose child to drugs include a Suspended Sentence, Intensive Corrections Order (ICO), Community Corrections Order (CCO) and a Good Behaviour Bond.

A 50-year-old man was arrested at a property in Chester Hill and taken to Bankstown Police Station where he was charged with the criminal offence of Allowing use of premises as drug premises – Expose child to drugs.
The arrest followed an investigation commenced by investigators from Wetherill Park Region Enforcement Squad into the supply of prohibited drugs in Sydney’s southwest.

A 28-year-old woman was also arrested and was charged with breach of bail and contravening an Apprehended Domestic Violence Order.
The two charged individuals were refused bail.
