Section 61JA of the Crimes Act 1900 (NSW) constitutes it a criminal offence if a person:
- Has sexual intercourse with another person without the consent of the other person and who knows that the other person does not consent to the sexual intercourse, and
- Is in the company of another person or persons, and
- who—
- at the time of, or immediately before or after, the commission of the offence, intentionally or recklessly inflicts actual bodily harm on the complainant or any other person who is present or nearby, or
- at the time of, or immediately before or after, the commission of the offence, threatens to inflict actual bodily harm on the complainant or any other person who is present or nearby by means of an offensive weapon or instrument, or
- deprives the complainant of his or her liberty for a period before or after the commission of the offence.

FOUR TEENAGERS CHARGED WITH MULTIPLE SEXUAL OFFENCES
Four teenagers have been charged over the alleged gang rape of a 17-year-old girl, following allegations the girl was subjected to a 6-hour ordeal which began when she was approached by one of the alleged offenders at a Liverpool shopping centre.
A 16-year-old male was arrested and charged with 24 offences, which included nine counts of sexual intercourse without consent, and eight counts of aggravated sexual assault with offender in company with other persons.
A 14-year-old male was arrested and charged with 10 offences, which included seven counts of aggravated sexual assault in company.
An 18-year-old man was arrested and charged with nine counts of aggravated sexual assault in company. He was a minor when the alleged offending occurred.
Also arrested was a 19-year-old man who was charged with five counts of aggravated sexual assault in company.
NSW Police allege that after the 16-year-old male approached the girl, he followed her to the carpark where she reluctantly let him into the car. It is alleged that he video called the co-accused teenagers whilst sexually assaulting the victim.
He allegedly refused to leave but promised to do so if the victim drove him to Wheat Park in Sadleir. The ordeal continued with the co-accused teenagers entering the vehicle and sexually assaulting the victim.
The teenagers were refused bail and are scheduled to next have their matters heard in Court in August 2025.
