Section 61I of the Crimes Act 1900 (NSW) defines the criminal offence of sexual assault as a person having sexual intercourse with another person without the consent of the other person and who knows that the other person does not consent to the sexual intercourse.
WHAT IS THE PUNISHMENT FOR THE CRIMINAL OFFENCE OF SEXUAL ASSAULT?
Section 61I of the Crimes Act 1900 (NSW) prescribes a maximum penalty of 14 years imprisonment for a person convicted of the criminal offence of sexual assault. A conviction of the criminal offence of sexual assault is likely to have lifelong implications on your professional and personal life.
WHAT IS THE CRIMINAL OFFENCE OF AGGRAVATED SEXUAL ASSAULT?
Section 61J of the Crimes Act 1900 (NSW) constitutes it a criminal offence for a person to have sexual intercourse with another person without the consent of the other person and in circumstances of aggravation and knowing that the other person does not consent to the sexual intercourse.
WHAT IS THE PUNISHMENT FOR THE CRIMINAL OFFENCE OF AGGRAVATED SEXUAL ASSAULT?
Section 61J of the Crimes Act 1900 (NSW) prescribes a maximum penalty of 20 years imprisonment for a person convicted of the criminal offence of aggravated sexual assault.
WHAT ARE CIRCUMSTANCES OF AGGRAVATION OF SEXUAL ASSAULT?
Section 61J of the Crimes Act 1900 (NSW) defines circumstances of aggravation of sexual assault as circumstances including, but not limited to:
- At the time of, or immediately before or after, the commission of the offence, the accused person intentionally or recklessly inflicts actual bodily harm on the complainant or any other person who is present or nearby
- The complainant has a serious physical disability
- The accused person is in the company of another person or persons
- The complainant is under the age of 16 years
- The accused person deprives the complainant of his or her liberty for a period before or after the commission of the offence

POLICE OFFICER ACCUSED OF RAPING WOMAN TWICE
Constable Jayden Turk has faced Court having been charged with the criminal offence of sexual assault, following allegations that the 25-year-old raped a woman twice in half an hour.
The alleged offences are said to have occurred after Constable Turk met the woman at a hotel in September 2023. Following his February 2025 arrest, Constable Turk was suspended without pay from the NSW Police Force, although he had not been on active duty since November 2023.
The case was adjourned until 8 July 2025 and Constable Turk remains on bail.
