WHAT IS THE CRIMINAL OFFENCE OF MURDER?

Murder is constituted as a criminal offence pursuant to Section 18(1)(a) of the Crimes Act 1900 (NSW) and is defined to have been committed where the act of the accused, or thing by him or her omitted to be done, causing the death charged, was done or omitted:

  • with reckless indifference to human life, or
  • with intent to kill, or
  • with intent to inflict grievous bodily harm upon some person, or
  • done in an attempt to commit, or during or immediately after the commission, by the accused, or some accomplice with him or her, of a crime punishable by imprisonment for life or for 25 years.

 

WHAT IS THE PUNISHMENT FOR THE CRIMINAL OFFENCE OF MURDER?

Section 19A of the Crimes Act 1900 (NSW) prescribes a maximum penalty of life imprisonment for a conviction of the criminal offence of murder.

The Standard Non-Parole Period for the criminal offence of Murder is 20 years imprisonment.

ERIN PATTERSON FOUND GUILTY OF MUSHROOM MURDERS

Erin Patterson has been convicted in Victoria of the criminal offence of Murder, after a jury found that she had murdered three relatives and attempted to murder a fourth by serving them food laced with death cap mushrooms.

The trial lasted two and a half months and made global headlines.

The case is reported to have attracted so much attention that there was an economic boom in Morwell, the location of the trial, and the nearby town of Traralgon.

The fateful lunch occurred at Erin’s home in the regional Victorian town of Leongatha on 29 July 2023. Her parents-in-law, Don and Gail Patterson, and Gail’s sister, Heather Wilkinson did not survive the poisoned lunch that Erin had served them, whilst Heather’s husband Ian Wilkinson survived.

Erin was also convicted of the attempted murder of Ian Wilkinson.

Erin’s lawyers unsuccessfully argued that the serving of the poisonous lunch was a tragic accident, although the jury was convinced of the prosecution’s position that Erin had deliberately poisoned her victims with murderous intent.

 

CONVICTED MURDERER ERIN PATTERSON TO FACE SENTENCING HEARING

The convicted triple murderer Erin Patterson will proceed to face a Sentencing Hearing later this year following her convictions. She will have 28 days from the date of her sentence to decide if she will appeal her guilty verdicts.
