WHAT IS DOMESTIC VIOLENCE?

The Crimes (Personal and Domestic Violence) Act 2007 (NSW) defines a domestic violence offence as an offence committed by a person against another person with whom the person who commits the offence has (or has had) a domestic relationship, through a broad range of offences.

In NSW there is no specific singular ‘domestic violence’ offence, but rather domestic violence acts may constitute criminal offences that are committed against a person with whom the alleged offender is in a domestic relationship in, such as common assault, intimidation and murder.

WHAT IS A DOMESTIC RELATIONSHIP?

Section 5 of the Crimes (Personal and Domestic Violence) Act 2007 (NSW) defines what a domestic relationship is and includes, but is not limited to:

  • Being or having been married to the other person;
  • Being or having been a de facto partner of the other person;
  • Having or having had an intimate personal relationship with the other person, whether or not the intimate relationship involves or has involved a relationship of a sexual nature;
  • Living or having lived in the same household as the other person;
  • Is or has been a relative of the other person.

WHAT ARE THE PUNISHMENTS FOR DOMESTIC VIOLENCE OFFENCES?

The punishments for domestic violence offences depend on which offence the domestic violence was committed within. Our specialised domestic violence lawyers offer a free consultation where they will discuss your specific domestic violence offence and the penalties that may arise from a conviction of the domestic violence offence.

MAN CHARGED WITH ALLEGED DOMESTIC VIOLENCE OFFENCES

A man has been charged with two counts of stalk/intimidate intend fear physical etc harm, common assault (DV), and destroy or damage property (DV) arising from allegations of serious domestic violence offences following a joint investigation by general duties and specialist police.

On 13 February 2025, police from the Orana-Mid Western Police District were notified of an alleged domestic incident at a property in the rural NSW town of Turill. The man is alleged to have driven his vehicle towards a woman known to him, causing her to fear for her safety, before threatening her and damaging property.

On 18 February 2025, police from the Hunter Valley Police District located and attempted to arrest the alleged offender, although he is alleged to have run into bushland and police were unable to locate him.

On 12 March 2025, the Hunter and Western DV High Risk Offender Teams (DVHROT), assisted by Hunter Valley Police District, Northern Region Operational Support Group, the Dog Unit and PolAir, commenced a search for the man at the Turill property.

The alleged offender was located in a cave and was arrested, before being taken to Mudgee Police Station and charged with the domestic violence offences.

He was refused bail.
