So what is a Domestic Violence Charge?

A Domestic Violence Charge is when you have a domestic relationship with another person and you: assault, or attempt or threaten to assault, that person, destroy or damage their property or harm their animal (or threaten to do this).

What is a domestic relationship?

A domestic relationship includes and is not limited to people who are, or have been:

Ø Married;

Ø In an intimate relationship

Ø De facto

Ø Living in the same household etc

What happens when you are charged with a Domestic Violence Offence?

Ordinarily, after a domestic violence complaint is made, the Police will attend your residence and place you under arrest. You are then taken to the closest police station where you will go through a “charging process.” You may be offered an opportunity to take part in an interview. It is very important you contact our Domestic Violence Criminal Lawyers to advise you on your rights and until you obtain that advice, keep your mouth shut.

If you are formally charged, the police will make a decision whether or not to grant you bail. If you are granted bail, you will receive your court attendance notice (commonly referred to as a CAN) which will advise you of when you are required to attend court. If you are bail refused, you will be brought before a Magistrate at the earliest opportunity. This is where our Domestic Violence Criminal Lawyers will appear on your behalf and argue for your release on bail. To see more information about bail applications visit our page here.

How long will it take to resolve a domestic violence charge?

Whilst the Local Court recognises the need to resolve these matters swiftly, different court houses have different waiting times. Typically, a domestic violence charge can take 3-6 months to resolve. At some court houses the wait times can be 9-12 months if the charges are to be defended.

Can I avoid a criminal conviction if charged with a Domestic Violence Charge?

Yes, At Criminal Lawyers Group, our Domestic Violence Criminal Lawyers have a track-record of successfully defending domestic violence charges. In the circumstances we are instructed to plead guilty to a domestic violence case, we will make submissions to persuade the court to impose a no conviction result. This means that you will not have a criminal conviction recorded.
