WHAT IS THE CRIMINAL OFFENCE OF KIDNAPPING?

Section 86 of the Crimes Act 1900 (NSW) establishes three types of the criminal offence of kidnapping: Basic Offence, Aggravated Offence and Specially Aggravated Offence.

Basic Offence

Section 86(1) of the Crimes Act 1900 (NSW) constitutes the Basic Offence of Kidnapping as having been committed when a person takes or detains a person, without the person’s consent:

  • With the intention of holding the person to ransom, or
  • With the intention of committing a serious indictable offence, or
  • With the intention of obtaining any other advantage.

The maximum penalty for a conviction of the Basic Offence of Kidnapping is a term of imprisonment of 14 years.

Aggravated Offence

Section 86(2) of the Crimes Act 1900 (NSW) constitutes the Aggravated Offence of Kidnapping as having been committed when a person commits the Basic Offence of Kidnapping in the company of another person or persons, or commits the Basic Offence of Kidnapping and at the time of, or immediately before or after, the commission of the offence, actual bodily harm is occasioned to the alleged victim.

The maximum penalty for a conviction of the Aggravated Offence of Kidnapping is a term of imprisonment of 20 years.

Specially Aggravated Offence

Section 86(3) of the Crimes Act 1900 (NSW) constitutes the Specially Aggravated Offence of Kidnapping as having been committed when a person commits the Basic Offence of Kidnapping in the company of another person or persons, and at the time of, or immediately before or after, the commission of the offence, actual bodily harm is occasioned to the alleged victim.

The maximum penalty for a conviction of the Specially Aggravated Offence of Kidnapping is a term of imprisonment of 25 years.

 

WHAT OTHER PENALTIES ARE AVAILABLE FOR THE CRIMINAL OFFENCE OF KIDNAPPING?

Other penalties available for a conviction of Kidnapping include an Intensive Corrections Order (ICO), Community Corrections Order (CCO), Community Release Order (CRO) and a Fine.

EX CHAMPION BOXER CHARGED WITH KIDNAPPING

Ex-professional boxer Humzah Khalid was charged with the criminal offence of kidnapping, arising from the alleged kidnapping of a man in 2025. The investigation was overseen by the State Crime Command’s Robbery and Serious Crime Squad, under Strike Force Hazelvale.

The victim claims to have been travelling with another person to a home in Ryde, when he was approached by two unknown men who allegedly assaulted and kidnapped him at gunpoint. After a period of time, the victim is alleged to have been returned to his vehicle in Hunters Hill.

Mr Khalid was alleged to have been involved in the kidnapping. He was refused bail and faces further criminal charges in relation to three other alleged kidnappings.
